Agreement
Making a purchase on www.psychbuddy.com.au (the "PsychBuddy Website") involves creating a legally binding contract, the “Agreement”, between you and owner of PsychBuddy, Adele Bergin (just the two of “us” 🎶). The parties to this Agreement are: (1) the person who makes the purchase and enters into the Agreement, referred to throughout the Agreement as “you” or “your” or "the attendee", and (2) Adele Bergin, the Individual/Sole Trader (Australian Business Number 86 209 017 633) who owns PsychBuddy, and is is referred to in this Agreement as “PsychBuddy” or “they”, or “their”, or “we” or “our”.
PsychBuddy provides workshops and services to you subject to this Agreement, so as always with a binding contract, you should read through it carefully before making a booking. 🤓 PsychBuddy may make changes to the terms and conditions of this Agreement, but the latest version will always appear on this page. If you continue to use our website or services after changes have been made, you will be considered to have accepted the changes to the Agreement between us.

Definitions
In this Agreement, the following capitalised words have these specific meanings.

‘Event’ means any event or facility offered on the website, including without limitation, workshops, classes, events, and webinars.

‘PsychBuddy Website’ means www.psychbuddy.com.au
​
‘Terms and Conditions’ refers to the terms of the Terms and Conditions within this Agreement.
Event Details
Details of the Event are outlined under "Service Description" on the booking pages of the PsychBuddy Website. These details include the Event presenter, time, date, and location (including how you will receive access to virtual events), content, and any included materials (including any on-demand access to re-watch live Events). Please note, this Service Description also details when on-demand access will expire.

The Event Booking Process
When you book an Event through the PsychBuddy Website, the booking won’t be confirmed until you receive a booking confirmation even if you‘ve transferred money to PsychBuddy. PsychBuddy do reserve the right to refuse bookings for any lawful reason, although PsychBuddy don’t expect to have to do this very often.

PsychBuddy will usually email you your booking confirmation, along with an invoice, to the email address you provided when you made your purchase, within 24 hours of booking. This invoice is proof of purchase for workshops booked and paid for online. If you have not received your booking confirmation within 24 hours of booking, please check your spam or junk email folder. If you still can’t find them, please contact PsychBuddy at hello@psychbuddy.com.au. It is your responsibility to ensure that your email is set up to allow you to receive your booking confirmation, and PsychBuddy cannot accept any liability for any consequences of your not doing so.
Please make sure that you check the details of the Event carefully as soon as you receive the email. It is your responsibility to do this and we won’t be able to help if you get the date, time or online location wrong.
The price for each Event is displayed on the website and must be paid in full by credit card at the time of booking.
An email will be sent prior to live Events as a reminder of relevant information regarding location, date, time and inclusions i.e., workshop materials.
Cancellations or Changes to Event Bookings
Event Booking Refunds

When you make a booking for an Event, PsychBuddy cannot offer refunds if you decide not to attend an Event or to cancel your booking.

Our policy is as follows:

All events are non-refundable if you change your mind.

If you book for a live or online Event and then for whatever reason you don’t actually attend you are not entitled to any refund.

All bookings and Event purchases are non-transferrable.

Whilst, pursuant to this agreement, PsychBuddy has no obligation to refund or exchange purchases for an Event, if you experience financial hardship or your circumstances unexpectedly change following the purchase of a live Event (but prior to that Event occurring) (e.g., you withdraw from your university course), and you wish to apply for a refund, please contact us at hello@psychbuddy.com.au
Event Cancellations or Changes by PsychBuddy

We REALLY never want to, but...
If PsychBuddy needs to cancel, postpone, re-schedule, or change venues (including online servers) of an Event for any reason, they may do so at any time before the Event is scheduled to begin. PsychBuddy does not expect this to happen except in exceptional circumstances, and of course will refund your ticket money in full, or offer you a choice of alternative date or Event. Unfortunately, we won’t be able to compensate you for any other expenses you may have incurred in connection with the Event.
PsychBuddy will try to notify you of cancellations via the email you provided on the booking form, but we can’t guarantee this, especially when an Event is cancelled at short notice.
Whilst facilitators, topics and timings confirmed at the time of publishing, circumstances beyond the control of PsychBuddy may necessitate substitutions, alterations or cancellations of the speaker, timings and/or topics, although this is unlikely. Any substitutions or alterations will be updated on our webpage as soon as possible.
Intellectual Property & Use of Copyrighted Materials (OR Please don't give away all of our hard work... ðŸ˜)
PsychBuddy holds ownership of all intellectual property (including Copyright) used during the PsychBuddy Events unless otherwise stated. This includes, but is not limited to; all text, images, videos, graphics, audio commentary, visual presentations, logos, methodologies, processes, and any Event related materials.

All Event materials cannot be copied, reproduced or distributed in any form without the prior written approval of PsychBuddy.

You are granted a limited licence to use these copyrighted materials for your personal use. This limited licence does not extend to anyone else. You agree not to distribute these materials or physical or digital copies of these materials to any other person or entity else unless they have previously received written permission from PsychBuddy. The participant agrees that violating this limited licence without such written permission will subject the participant to full legal penalties for copyright infringement.

Do not share the unique join link to the on-demand version of an Event. It is intended for your exclusive use.

To assure confidentiality of audio or video recording of Events by participants is not allowed.
Right to Suspend or Cancel User Account
PsychBuddy may permanently or temporarily terminate or suspend your access to the Event (including access to the on-demand version of an Event) without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time by contacting us at hello@psychbuddy.com.au

Limitations of Liability
To the maximum extent permitted by applicable law, PsychBuddy assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content of the Event; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of materials from the Event; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.
Please note, you attend the Event at your own risk. We accept no responsibility for any of the following:

Costs or expenses whatsoever or howsoever arising out of or in connection with any Event.

Loss of data, profit, revenue, use, business, anticipated savings, goodwill, reputation or opportunity, financial or economic loss or any indirect or consequential loss or damage.
Privacy Policy
PsychBuddy collects and retains personal information as part of its booking process for the purpose of identification, payment and communication with attendees. PsychBuddy respects your privacy and confidentiality, and the Australian privacy laws and will not release or sell delegates personal information to any company or organisation except where it is required by law by subpoena, or where there is it is necessary to protect PsychBuddy’s legal rights.
